Political legitimacy and constitutional compatibility: the reception by jurists of the proposals of an exclusive constituent assembly to change the political system

Abstract

This paper analyzes the reception by the legal community of the proposals to convene special constitutional process to reform the Brazilian political system, having as its goal comprehend the role played by constitutional theory on its understanding of the political phenomena. It was conducted a survey on the complaints made by jurists over the proposals for exceptional reform of the constitution in order to show the influence of the constitutional doctrine on the legal discourse – with particular emphasis on the category of constituent power. The research sheds light on how the reception of a originally revolutionary concept by liberal constitutionalism led to its redefinition, becoming from a legitimizing element of rupture of the order to a legitimizing element of maintenance of the order and sheds light on the function played by references to constitutional theory in the speech of jurists about the proposals for the modification of the constitutional provisions on political system through exceptional proceedings, which lead to subjugate political practice to legal theory. Thus, it helps to clarify how the contemporary legal discourse reduces political legitimacy issues to constitutional adequacy issues, resulting in a legal theory with a typically conservative paper. Instead of fostering discussion on the legitimacy and convenience of constitutional innovations to deal with the system limits, the doctrine prevents the debate and holds the liberal discourse above the democratic discourse In the end, the study highlights the consolidation of a legal culture that does not propose the articulation between law and political, but the subordination of political discourse to legal discourse.
